Tax Incentives - Useful tax information for filming in Florida, USA

20%–30% Transferable Tax Credit
Maximum Benefit

20% transferable tax credit (30% maximum with bonuses). Three incentive programs:

  • General Production Queue (GP)

  • Commercial And Music Video Queue (CMV)

  • Independent And Emerging Media Production Queue (IEMP)

Bonuses:

  • 5% Off Season Bonus (for certain production types).

  • 5% Family Friendly Bonus (for certain production types).

  • 5% Underutilized Region Bonus (for GP only).

  • 5% Qualified Production Facility/Digital Media Facility Bonus (for GP, on expenditures associated with production activity at a Qualified Production Facility/Digital Media Facility).

  • 15% Florida Student/Recent Graduate (for GP, on student/recent grad wages and other compensation).

Compensation and Project Caps/ Funding Per Year

FUNDING And CAPS: All funding for this program has been allocated. Funding is on a first-come, first-served basis (however, some high-impact TV series and digital media projects may have priority dependent on criteria).

Annual Cap: $296M through fiscal year 2015-2016.

Project Cap:

  • GP: $8M.

  • CMV: $500K.

  • IEMP: $125K.

Comp Cap: $400K per resident. Maximum $300K computer expenses unique to production.

What Qualifies

Qualified production expenditures includes the net in-state costs of tangible and intangible property used for and services performed primarily and customarily in production, including preproduction and post- production, but excluding costs for development, marketing, and distribution. A completed declaration of Florida residency must accompany documentation for each resident.

Application Considerations

Production company registration not required. Apply electronically before project start date but no earlier than 180 days before the first day
of principal photography to the address on the application. By 5:00 pm (Tallahassee time) the next business day following the date of the electronic application submittal, you must also submit electronic and hard copies of all required supporting schedules and documents (no hand delivery). Completed applications will be reviewed and qualified or denied within 20 business days. Be certified prior to the first day of principal photography.

Application Considerations

CPA audit required before final review/certification by the FL Film Office.

Carry Forward/Transfer: 5 Years. Irrevocable election required to apply credits to income tax, sales tax collected or accrued, or against a stated combination of both taxes.

Transfer Considerations: One-time transfer to no more than four transferees for income tax credits, and one-time transfer to no more than one transferee for sales tax credits allowed within five years after tax credit is awarded. Initial transferee allowed a one-time transfer to no more than two subsequent transferees. Subsequent transferees not allowed to transfer the tax credits.

Minimum 60% production cast and BTL crew must be legal FL residents (except digital media projects which requires a minimum of 75%).

GP Minimum spend: $625K.

CMV Minimum spend: $500K within the fiscal year (July 1 - June 30), can bundle projects. Eligibility: National or regional commercials, music videos, or both.

IEMP Minimum spend: $100K. Maximum spend = $625K. NOTE: Some high impact TV series are not eligible (if program cap has been reached).
